Who we are.
MADAME ARTWITCH is the trading name of Yulia Kireeva (also written as “Julia Kireeva” in public materials) (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our website and online store.

By accessing our website or purchasing from our store, you agree to these Terms. If you do not agree, do not use the Services.

1) Scope
These Terms apply to your use of the website and to purchases of original artworks and fine‑art prints (the “Services”). Separate policies (e.g., Privacy Policy, Refund/Returns Policy, Cookie Policy) form part of these Terms by reference.

2) Products
We sell original oil paintings and fine‑art prints. Each product page sets out key details (materials, dimensions, edition/print method, and any processing/dispatch information). Colours may vary between screens and the physical work. Dimensions are approximate. Frames are included only if explicitly stated.

3) Prices, taxes & duties
Consumer prices are shown with VAT where applicable. Shipping costs, duties and import taxes for non‑EU deliveries are shown or calculated at checkout or notified before dispatch and are your responsibility unless stated otherwise. Your bank/issuer may apply conversion or other fees beyond our control.

4) Orders & contract formation
Your order is an offer to buy. A contract is formed when we send an order confirmation email. We may refuse or cancel an order (e.g., suspected fraud, stock or pricing errors). We do not sell to resellers/distributors without prior written consent.

5) Payments
Payments are processed securely by our payment providers (e.g., Shopify Payments/Stripe/PayPal). We do not store full card details. Standard anti‑fraud checks may be carried out before accepting an order.

6) Shipping, processing & delivery
Processing/dispatch information is indicated on the product page or provided in the order confirmation. Delivery timeframes depend on the carrier and destination and may be shown at checkout when available. Risk passes to you upon delivery to the address you provided. If a parcel arrives damaged, contact us within 48 hours with photos of the packaging and item.

7) Right of withdrawal (EEA/UK consumers)
EEA/UK consumers have a 14‑day right to withdraw from distance purchases without reason.
How it works:
• Email madameartwitch@gmail.com within 14 days of delivery with your order number and a clear statement that you cancel.
• Return the goods within 14 days after your cancellation email. Keep proof of postage.
• We refund within 14 days of receiving the goods or valid proof of return (whichever is earlier), to the original payment method.
• You are responsible for return shipping unless the item is faulty. Any loss in value caused by handling beyond what is necessary to examine the work may be deducted.

8) Exceptions (no change‑of‑mind return)
• Commissions and clearly personalized works, including commissioned portraits and prints produced with personal text, bespoke options, or measurements made specifically for you.
• Items that have been mounted, framed, altered, or damaged after delivery.
• Any other statutory exceptions where applicable.
Note: Standard, non‑personalized prints and ready‑to‑ship original artworks are generally cancellable under the 14‑day rule in the EEA/UK.

9) Returns for faults or damage
If an item is faulty or arrives damaged, contact us promptly with details and photos. Where applicable, we will repair, replace, or refund in accordance with consumer law.

10) Return process & packaging
Contact us before sending any return so we can provide the correct return address and instructions. Use a tracked and insured service suitable for fine art and include your order number inside the parcel. Items must be returned in their original condition and in the original or equivalent protective packaging. You are responsible for the item until we receive it.

11) Intellectual property
All artworks, images, product descriptions and site content are owned by us or our licensors. You may not copy, reproduce or use them without prior written permission.

12) Acceptable use
Do not misuse the site (malware, scraping, spamming, unlawful or infringing activity). We may suspend or terminate access for violations.

13) Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect and process personal data. See our Privacy Policy for details.

14) Warranties & liability
The Services are provided “as is” to the fullest extent permitted by law. We do not guarantee uninterrupted or error‑free operation. Nothing in these Terms limits your mandatory consumer rights. To the extent permitted by law, we are not liable for indirect or consequential losses.

15) Force majeure
We are not liable for delays or failure to perform due to events beyond our reasonable control (including natural disasters, strikes, carrier issues, or regulatory actions).

16) Governing law & disputes
These Terms are governed by the laws of Spain, without prejudice to mandatory consumer protections of your habitual residence in the EEA/UK. We aim to resolve complaints directly at madameartwitch@gmail.com. You may also seek resolution through competent consumer authorities or courts as provided by law.

17) Changes to these Terms
We may update these Terms. The version posted at the time of purchase applies to that order. Continued use of the site after changes means you accept the updated Terms.
